General Terms and Conditions of Sri Lanka Safari
1.1 Srilankasafari.com operates a booking portal for safari car rentals with driver in Sri Lanka. The user of the portal can check the availability of safaris and rentals of rental cars with driver of various safari companies (collectively referred to as "providers") according to the entries made by you. Furthermore, the user can conclude a contract with the respective provider for the transportation, safari and duration selected by you.
1.2 Srilankasafari.de acts exclusively as an agent for the transportation services of the respective providers and arranges contracts in the name and for the account of the providers. Between Srilankasafari.de and the User, in the case of a booking of a transportation service, an agency agreement is concluded, the object of which is the procurement of the transportation service.
1.3 By registering, you make a binding offer to the selected Supplier to conclude a transportation contract. The contract is concluded by acceptance by the selected provider or by acceptance by Srilankasafari.de on behalf of the provider. The contract is also concluded when Srilankasafari.de or the respective provider sends an invoice to the customer.
1.4 The brokered contract is based on the provider's own General Terms and Conditions (GTC). These regulate payment terms, provisions on due dates, liability, etc. as well as other restrictions and obligations of the user. The corresponding GTC of the provider are made available to the user on the website for inspection and acceptance.
1.5 The text of the contract and the order data are stored for the purpose of processing the contractual relationship and forwarded to the selected contractual partners (e.g. transport companies, credit card companies, etc.) by way of contract processing.
- Obligations of the customer
Srilankasafari.de must be notified immediately of any defects in the agency service. If the user culpably fails to notify Srilankasafari.de of a defect, any claims of the user arising from the agency contract shall lapse, unless it is a matter of injury to life, limb or health. - Booking processing
The provider's price stated in the booking confirmation is binding. Srilankasafari.de is authorized and entitled to receive and collect the claim. Payment is possible by credit card (Visa or MasterCard), PayPal and bank transfer. In the case of payment by credit card, the amount is due upon conclusion of the contract and is debited from the specified credit card at this time. - Liability of Srilankasafari.de
4.1 The individual details of the transportation services are based on the information provided by the providers.Srilankasafari.de does not assume any guarantee for this. This does not apply if Srilankasafari.de was aware or should have been aware of erroneous and/or incorrect information. In this respect, liability for knowledge of such circumstances is limited to cases of intent and gross negligence.
4.2 Srilankasafari.de is not liable for the success of the mediation and/or the actual proper provision of the transportation service itself.
4.3 Otherwise, Srilankasafari.de shall only be liable for damages that do not involve injury to life, limb or health in the event of intent or gross negligence. This also applies to liability for assumed guarantees or liability for the violation of essential contractual obligations. In the event of negligent breach of cardinal obligations, liability shall be limited to foreseeable damage typical of the contract. In any case, unless injury to life, limb or health is involved, liability is limited to three times the value of the transportation service provided. Furthermore, liability for the consequences of force majeure, orders from authorities, civil unrest, hijacking, terrorist attacks, fire, floods, power failures, accidents, storms, strikes, lockouts or other industrial action affecting Srilankasafari.de or its suppliers is excluded.
- Choice of law and place of jurisdiction
The contractual relationship between the customer and Srilankasafari.de shall be governed exclusively by German law. Insofar as German law is not applied on the merits in the event of legal action by the customer against us abroad for our liability, German law shall apply exclusively with regard to the legal consequences, in particular with regard to the type, scope and amount of the customer's claims.

- Conclusion of the contract and payment
With the registration you offer us the conclusion of a binding transportation contract. The contract is concluded upon acceptance by us or by Srilankasafari.de on our behalf. Together with our confirmation, you will also receive your safari voucher by e-mail.
Payment is due on booking and can be made by credit card (Visa or MasterCard) or by SOFORT bank transfer and PayPal.
The amount will be debited by us or Srilankasafari.de from the credit card or account specified by you upon conclusion of the contract.
- We provide the booked safaris as follows:
- Safari four hours / two-wheel drive (2Wheel)
You rent a safari jeep for four hours with 2Wheel.
We will pick you up at your accommodation. You will receive the time with your travel documents. The safari lasts four hours. You will be chauffeured in a two-wheel drive vehicle.
The time of the safari begins with the pick-up at the accommodation and ends with the arrival at the accommodation.
Meals, entrance fees, personal expenses and tips are not included in the price.
All our drivers are instructed and trained for their park.
- Safari four hours / all-wheel drive (4Wheel)
You rent a safari jeep for four hours with 4Wheel.
We will pick you up at your accommodation. You will receive the time with your travel documents. The safari lasts four hours. You will be chauffeured in a four-wheel drive vehicle.

- Changes in performance
A change of services after conclusion of the contract at your request is only possible in the following cases:
If you have opened a customer account, you can make changes to the data on the desired travel date yourself via Srilankasafari.de. Otherwise, please send us an e-mail stating the booking number and the name of the person making the booking.
Changes are possible up to 48 hours before scheduled arrival. Failure to notify us of changed dates will void our obligation to provide transportation.
The travel date can be postponed by a maximum of three days.
It is not possible to change the destination or mode of transportation.
- Prices and price changes
The prices are calculated on a daily basis and can be changed at any time prior to the conclusion of the booking without prior notice, but not retroactively with regard to contracts already concluded.
In very rare cases, fees, taxes or price increases for fuel (i.e. tolls, VAT or other taxes, price increases for gasoline or diesel, etc.) may be subsequently introduced or increased in the period between the issued booking confirmation, i.e. the conclusion of the contract and the start of the contract, over which Srilankasafari.com and the providers have no influence and could not have foreseen at the time of the conclusion of the contract with the customer. In these rare cases, Srilankasafari.com has the right to demand these subsequently introduced or levied fees or taxes or the price increases from the customer in addition to the price stated in the contract if there is a period of at least four months between the time the voucher is sent to the customer and the start of the contract. If Srilankasafari.de makes use of this right on behalf of the providers before the start of the contract and demands payment of such fees or taxes or price increases, the customer shall have the right to withdraw from the contract in writing or in text form (e-mail to support (at) Srilankasafari.de) within two weeks of receipt of the request for an increase from Srilankasafari.de, but at the latest by the day before the start of the contract. The customer will then be reimbursed immediately for any payments already made towards the contract; the customer should therefore be sure to state his bank details in any letter of withdrawal. The customer cannot make any further claims in such a case. Srilankasafari.de and the providers shall bear the burden of proof for the existence of the prerequisites for the right to increase the price in accordance with this paragraph. Failure by the Customer to exercise the right of withdrawal in good time shall be deemed tacit consent to the price increase; Srilankasafari.de shall therefore acquire an additional claim for payment against the Customer in this case. Srilankasafari.de shall expressly point this out to the Customer in writing or in text form in the event of any subsequent request for payment.
All prices are valid at the time they are requested. Price changes or changes to the conditions are possible at any time and without prior notice for reservations that have not yet been confirmed by sending a voucher, i.e. until the contract is concluded. In addition, we reserve the right to change prices (as listed above).
- Termination
You can withdraw from the contract at any time before the start of transportation. To avoid misunderstandings, the withdrawal should be declared in writing. Failure to start will be treated as a withdrawal. The date of withdrawal is determined by the date on which we receive the declaration of withdrawal. If you withdraw from the contract or do not take up the transportation services, we can demand compensation for our expenses and the travel arrangements made. You expressly reserve the right to prove to us that no damage or only significantly less damage has been incurred.
As a rule, the withdrawal costs that we have to charge are as follows:
- up to 72 hours before the start of the transportation service EUR 34.00 / per booking
- 100 % thereafter and if the transportation service is not commenced.
- Limitation of liability
Our liability for contractual claims for damages is limited to a total of three times the transportation price, provided that the damage was not caused intentionally or through gross negligence by us or a service provider and does not involve physical injury.
You are liable for the provision of complete and correct flight information. If this information is not correct, any claim for transportation is void and claims for damages against us are excluded.
